Anti-defection court case: Petition to prevent influence on Supreme Court

Former MP Hussain Ali's case will be heard at the Supreme Court on Monday.

A petition has been submitted to the Supreme Court seeking to prevent outside influence in the case contesting the recent anti defection amendment to the constitution causing sitting parliament members lose their seats if they leave or are removed from the party they were elected with.

The order was sought by former Kurendhoo MP and attorney Ali Hussain, who filed the original petition as well.

In a letter to Chief Justice Ahmed Mu-uthasim Adnan, Ali Hussain expressed concern over reports that the Judicial Service Commission (JSC) is investigating disciplinary cases against Supreme Court judges and preparing to launch a criminal probe into one of them. He also noted speculation that efforts are underway to submit parliamentary motions for the removal of certain judges, coinciding with the scheduled hearing on the constitutional amendment case on Monday.

The Judicial Service Commission (JSC) is investigating disciplinary cases against some Supreme Court judges and a criminal investigation against a judge run, and is preparing to move parliament to remove the judges.

If such events are to take place, it could impede the establishment of justice, the letter said.

Citing this, Ali Hussain sought an order against all state agencies not to influence the Supreme Court.

In the letter, he highlighted the Supreme Court reserves the authority to issue such an order if judges are prevented from working independently.

This is the first case filed in a Maldivian court to quash a constitutional amendment. Opposition parties, MDP and The Democrats have also supported the case.
