Aswaan released due to incorrect remand request: Court

The Criminal Court said today that the police incorrectly requested to keep Aswaan Mohamed in custody pending investigation following his arrest via an Interpol Red Notice.

Aswaan, along with Mohamed Sibth Abdulla and Mohamed Ahsam, was involved in an assault with a dangerous weapon at Cibo restaurant in Male' City on September 4, 2023.

The three suspects were arrested after being deported from Thailand.

While Sibth Abdulla and Mohamed Ahsam were placed in custody pending trial, Aswaan was released on bail.

The court noted that Aswaan had previously been arrested and remanded in custody last year, but was released due to a lack of evidence.

However, after the Criminal Court's decision was appealed, the High Court quashed the order and instructed a decision on Aswaan’s remand. By then, Aswaan had left the Maldives, leading to an Interpol Red Notice being issued.

Criminal Court clarified that Aswaan had been charged with assault with a sharp object by the Prosecutor General's Office earlier in January.

The police requested his arrest on grounds of being a threat to society if released, but Aswaan's defense argued that no specific charge for absconding was mentioned in the remand request.

The court referred Article 8 of the Criminal Procedure Regulation, which stipulates that the Prosecutor General’s Office must submit the necessary documents to decide on the custody of the accused.

The court ruled that the police's request to decide on Aswaan's remand was a violation of this article, as his case had already been accepted by the PG office and charged by the court.
