Civil Court has ruled that SIFCO was right not to hand over a housing flat to National Counter Terrorism Center (NCTC) Director General Major General (retd) Wais Waheed, after finding that he had submitted invalid information to obtain the property.
The case concerned a flat under the SIFCO Hiyaa housing project, announced in November 2013, comprising 300 units. Although Waheed had signed the agreement and made the initial payment, the flat was withheld after it was discovered that he owned more than 600 square feet of land in Male', which disqualifies the recipient under the housing scheme.
Documents showed that H. Soasun Villa, a 3,800 square feet property, was registered under six individuals, including Wais Waheed. In October 2014, the land was subdivided, with Waheed and two others registered as co owners of a 1,900 square feet plot. The judgment noted that Waheed did not deny ownership of more than 600 square feet of land in Male'.
The flat agreement clearly stipulated that applicants must not own more than 600 square feet of land in the Greater Male' area, including Male', Hulhumale', Vilimale', Gulhifalhu, Thilafushi, and Giraavaru Falhu and required the surrender of such land before signing. It further provided for termination of the agreement if false information was submitted.
“Since the plaintiff’s statement and the documents submitted show that the plaintiff has not complied with Article 14 of the agreement, there is no judicial or legal basis to determine that SIFCO has breached the agreement in not handing over the flat to the plaintiff,” Judge Abdul Nasir Shafeeq ruled
