Chief judges may be dismissed at JSC's discretion

The procedure currently in practice does not contain a mechanism to remove chief judges.

The Judicial Service Commission (JSC) has formulated a regulation allowing chief judges of courts to be dismissed from their posts if the commission wishes.

The commission today gazetted a regulation on the procedure for appointing and removing chief judges for the courts.

According to the regulation, if the JSC deems it necessary to remove appointed chief judges from their posts to strengthen court administration, the commission possesses the power to remove that judge from the position.

The procedure currently in practice does not contain a mechanism to remove chief judges. Until now, a chief judge leaves office either if the judge resigns from the post voluntarily, or if the Parliament decides to dismiss the judge from their judicial position.

Applications for the position of chief judge are opened by the JSC. The judges applying for the position must be interviewed, and a person must be appointed to the post by a majority vote of the commission's members.
