Court rules MVR 500,000 owed to ex-wife in owed sum case

The Supreme Court ruled on a case where an ex-wife had filed a case against her ex-husband after their divorce.

In the Supreme Court case where it was ruled an ex-wife can be owed their expense put toward their life during marriage from the ex-husband, the lower court has sentenced the ex-husband to pay MVR 500,000 to the ex-wife.

The Supreme Court ruled on a case where an ex-wife had gone to court against her ex-husband after their divorce. The case covers a man from Dh. Kudahuvadhoo who had received a plot from the island, whereby the married couple was set to register the plot under their names after the wife had covered construction expenses for the plot.

The ex-wife filed a case to be reimbursed for approximately MVR 1.2 million, claiming the ex-wife had requested her ex-husband that two of their children receive a portion of the residence. However, the ex-husband did not respond.

As the case was ruled against in the Kudahuvadhoo Magistrate Court and High Court, the ex-wife appealed the case at the Supreme Court, with the court ruling that women can reclaim expenses made during marriage from their husband if they were to get divorced.

The Supreme Court voided the lower courts' sentence. The property tied up in the case was valuated, with it being determined the ex-wife was to receive half of the valuation. And so, the case was referred to the Kudahuvadhoo Magistrate Court in obtaining the valuation.

The Kudahuvadhoo Magistrate Court has inspected the state of the building in looking into the referral case. The court determined the price of the building to be MVR 1 million. The court ordered the ex-husband to pay the ex-wife MVR 541,000 within 6 months.
