Supreme Court has declined to issue an interim order to prevent the loss of parliamentary seats by MPs who leave or are expelled from the parties under which they were elected.

The decision comes in a constitutional challenge filed by former Kendhoo MP Ali Hussain, who is seeking to quash an amendment affecting loss of seats.

Hearings in the case have concluded, and the court is yet to deliver its verdict. Pending the ruling, Ali Hussain’s lawyer requested an interim order to halt any action that could lead to MPs losing their seats due to resignation or expulsion from their parties.

The petition also sought an order preventing any action against the Supreme Court judges hearing the case.

In its ruling, the court said such interim order could not be granted as it would affect the substance of the case itself.

On the request concerning the judges, the court said issuing such an order would contravene the principle that judges cannot make a decision on matters in which they have a personal interest.
