A hearing for the case submitted to the Supreme Court seeking to nullify the constitutional amendment which dictates that Members of Parliament shall lose their seats if they resign or are dismissed from their party has been scheduled for next week.

The case to nullify the constitutional amendment, which ensures the loss of seats for members who leave or are removed from the party they were elected under, was submitted to the Supreme Court by the former Member for the Kendhoo constituency, Ali Hussain.

The last hearing of this case by the Supreme Court was held in February of last year. However, the Supreme Court has now scheduled a hearing for the case for next Tuesday.

The Supreme Court is presiding over this case with a full bench of seven justices, chaired by Chief Justice Abdul Ghanee Mohamed.

Hearings for the case were previously halted following the suspension of Justice Dr. Azmiralda Zahir, Justice Mahaz Ali Zahir, and Justice Husnu Al Suood, who were part of the bench at the time. Following investigations into their conduct by the Judicial Service Commission (JSC), Justice Suood resigned from the bench. Justice Azmiralda and Justice Mahaz were removed after the JSC forwarded their dismissal to the Parliament, which subsequently passed the motion.
