An individual has taken a case to court where they had bought a Vinares Flat at its initial purchasing price, but has not been compensated for the difference after the price of the flat changed. The individual had been told that the difference would be paid to them but it still has not been done to this day.
The plaintiff pressed charges against the Housing Development Corporation's (HDC) Hulhumale' Division at the Civil Court, with it stating that HDC was paid in full for the Vinares Flat with the loan that was taken out from Bank of Maldives (BML).
After the transaction had been carried out, HDC had announced the flat price changes, offering a concession for buyers. The down payment for the flat was reduced to 50 percent, with the monthly six percent interest rate payment reduced to MVR 4,200.
The announcement also stated that people who had bought the flat via the bank can also make use of the change. And so, HDC had offered the concession to some who had bought flats.
However, the plaintiff states that the concession has not been granted to them to this day.
With that, they filed for a ruling of discrimination as per the Constitution, and to determine that the funds paid by the bank being used by HDC is an unfair advantage and wealth that was gained by HDC.
The plaintiff requested to rule that the additional money acquired from the bank that was paid to the HDC should be given back to them.
When this case was taken to court, HDC questioned the jurisdiction of the court rather than claiming accountability. Yesterday, the court came to the decision that this case is under their jurisdiction, with HDC having been told to prepare their defense against the charges.
