A man has gone to court in order to reclaim an iPhone that was given to his partner as a promise of marriage.
A civil suit presented by the individual to a court in a northern island, sought reclaim the iPhone 16 Pro Max 256 GB that was "taken through fraud and deception and used" while a promise of marriage was made between the couple. The suit also seeks MVR 10,000 as lawyer fees should also be paid by the partner.
Instead of denying the charges, the objection that was presented by the woman states that the "accusation of acquiring the phone through fraud and deception and fleeing without giving it back" is a criminal accusation. And so the woman stated that the case can only be presented to court by the Prosecutor General after an investigative agency has investigated the matter, along with the established result.
And so, she said that this is not a civil case that can move forward by being individually submitted to the Magistrate Court, and requested the charges be revoked.
In response to the objection, the man stated in court that he had submitted the case to reclaim property. He referred to a precedence that was established by a Civil Court judge in order to support his response. He also said that there is no legal reason the charge can be categorized as criminal or civil even though the words "fraud and deception" are used.
The decision to move the case forward stated that the woman did not respond to the individual's response.
The woman stated in the courtroom that there is "nothing more to be said" in response to the charges presented by the prosecution.
And so the court decided to proceed with the case.
