Major amendments have been brought to the Regulations on Employing Foreigners in Maldives. 

Changes brought to the regulation last Sunday include extending the work permit duration for unskilled labourers from five to ten years. 

Employer changes can be brought after one month passes without paying work permit fee, and a no objection letter from the employer. 

As per the changes, if an employer reports an expatriate missing, during the period when it is announced by the ministry, the expatriates will be given the option of changing employers under special circumstances. This will be done if it is proven that the employer has been negligent towards the expatriate. 

Circumstances where work permits will be voided have also been added to the regulation. New circumstances added to the regulation include if the employer attests on the XPat System that the expatriate has left the country, if a relevant authority declares the expatriate deceased, or if an expatriate receives Maldivian citizenship. 

Work permits can also be voided if an expatriate asked to leave the country due to health complications does not do so in the given timeframe, if an expatriate remains out of Maldives for over four months while the work permit is valid, and if an expatriate does not meet requirements for a work permit due to technical issues. 

Important amendments

  • If a report about a missing expatriate is retracted, or if revoked work permits are reissued, a new work permit will be issued through the XPat system. The new permit will be issued after transferring the deposit from the previous permit.
  • Work permits will be revoked if an investigative authority or the ministry is unable to proceed an investigation for 10 days due to non-cooperation from the involved expatriate.
  • If the employer cancels a work permit of an expatriate who left the Maldives before January 1, 2023, then quota fee will not be charged for it. 
  • However, if the work permit was cancelled, and the slot changed, then quota fee will be charged for the slot. 
  • The chapter on legalizing expatriates working without a valid permit has been entirely removed. This was replaced with a chapter on inspecting and monitoring expatriate work sites, as well as an article on legalizing expatriates living and working against regulations. 
  • A chapter was also added regarding the number of expatriates that can be brought to Maldives, and areas of work. 
  • A policy was also established on government-granted concessions on expatriate related fees. 
  • Procedures to follow in the instance the XPat system faces a technical issue is also included. 
  • A list of jobs that cannot be filled by expatriates, compiled by the cabinet, was also included in the regulation.
  • The regulation also includes a policy on fines and action that can be taken against those who violate this regulation.
