Lamha back in Police custody after suspended Judge Faiz's ruling changed

The Criminal Court has ruled to put Lamha back into Police custody after their ruling of releasing her from custody was changed. Haleemath Lamha was accused in the murder of IGMH nurse Mary Grace.

The Criminal Court has ruled to put Lamha back into Police custody after their ruling of releasing her from custody was changed. Haleemath Lamha was accused in the murder of IGMH nurse Mary Grace.

Lamha was placed in remand until 2023 when the Criminal Court had released her under conditional bail. However, the High Court had concluded that the Criminal Court had issued a wrongful ruling. Lamha had been granted bail on two occasions, with the High Court voiding the ruling and ordering her sentence be arranged.

However, Lamha has been released since December 2024. While the Prosecution has requested numerous times that she be placed into custody, presiding Judge Hussain Faiz Rashad stated that an assessment be conducted regarding how dangerous she is.

Criminal Court Judge Hussain Faiz Rashad has since been suspended regarding the release of Ali Anwar Mohamed from remand, who was accused of being a drug lord in smuggling narcotics into the country, along with another case that is being investigated by the Judicial Service Commission (JSC).

During yesterday's Criminal Court hearing regarding Lamha's custody, the Prosecution stated that she was released from custody in such a way the Police could not monitor her, and that an assessment could not be conducted due to that.

The hearing was presided over by temporary Judge Ibrahim Zihuny. The judge ruled that while taking into account the accusations against Lamha and the evidence, there were no changes in her imprisonment and that there was no reason to do a danger assessment.

And so, the judge ruled that Lamha be placed in remand until the trial ends.

If Lamha is convicted of her crime, she will be sentenced to six years in jail. While she has been placed in remand until her trial ends, she has served three years in jail.

While Mary's husband Marvin had initially said that she had died due to her hanging herself, it was later revealed that it was an intentional murder, with Marvin being charged and Lamha having been charged on three counts. The Prosecution had also said that Lamha was in a relationship with Marvin.

The charges that were placed upon Lamha are:

  • Partaking in intentional murder
  • Unauthorized possession of another individual's property
  • Conducting acts that require permission without it

While Lamha and Marvin denied the charges, the Prosecution had submitted a substantial amount of evidence against them, totaling 110 pieces of evidence, with 74 witnesses being a part of it.

The Prosecution noted that Marvin had given differing statements regarding Mary's death, with the Prosecution stating that there is no evidence that supports Mary had died due to her hanging herself. The Prosecution also said that a scene was created in order to point towards Mary hanging herself. However, the Prosecution stated that Mary's postmortem showed that she had died due to attacks to her head and neck. Marvin is still currently in jail regarding his case.
