The Presidential Commission formed to investigate the case of Hawwa Yumn Rasheed's fall from a building has stated that the family refused to cooperate in providing a statement from Yumn.
Yumn was found fallen on to the roof of a warehouse at H. Mitaaz from what Police have said is a fanlight in the 9th floor stairwell of adjacent H. Fentenoy on the morning of April 18.
The Presidential Commission concluded their investigation into the case and publicized their report yesterday. As per the report, the Commission was unable to obtain a statement from Yumn.
Police have also recently stated that as of yet, they, too, have not been able to take Yumn's statement.
The commission's report said that when they had called Yumn's family for the purpose of arranging taking a statement from Yumn, the family had rejected the calls. Later, Yumn's brother in law Mohamed Mu'umin had called the commission and asked them to stop calling Yumn's mother and other family members, and stated that they did not wish to talk to the commission.
The commission further said that they had sent a letter to the family appealing to allow a commission member to visit Malaysia, where Yumn was then receiving treatment, to take a statement, or to allow taking a statement through video conference. However, no response was received to this letter.
The report said that further attempts had been made to contact Yumn's family members in an attempt to obtain Yumn's statement, but to no success.
The commission said that while Yumn's family wants justice for Yumn, it is imperative to obtain a statement from Yumn to achieve this. The commission stated that they did not believe it is ideal to complete their report without a statement from Yumn.
However, the report said that based on evidence obtained by the investigation, they did not believe that failure to receive a statement from Yumn would affect their findings. It stated that the commission had been able to reach the facts of the case without exception and they had fulfilled the purpose of the investigation.
After the investigation, the commission stated that they are unable to categorically say whether Yumn had been or had not been deliberately pushed out of the fanlight in the stairwell. However, based on their findings, there is less likelihood that Yumnu was deliberately pushed, they said.
The commission stated that they lean towards Yumn having fallen out of the fanlight in the stairwell. The report said that these findings were based on the fact that there is no evidence to indicate Yumn had been pushed, or had jumped, and on the manner of Yumn's actions at the time, as well as the fact that she had been in a state of intoxication.
