Raudh Ahmed Zilal, arrested in relation to Hawwa Yumn Rasheed's fall from a building, has been released from custody last night.
Police said that Raudh was released late last night. The last remand order of five days issued against him by the Criminal Court also expires today.
Police, meanwhile, have forwarded his case for prosecution. The Prosecutor General's Office (PG Office) has said that they will reach a decision on prosecution within fifteen days.
Yumn was found fallen on to the roof of a warehouse at H. Mitaaz on April 18 with severe injuries. Police said that she had fallen from a fanlight in the 9th floor stairwell of adjacent H. Fentenoy.
Raudh was the last person seen accompanying Yumn on the night of the incident. He was arrested on April 24, six days after the incident. His detention was extended six times. Initially, he was placed in remand in custody for a period of five days, with it later being extended by another ten days. At the end of this period, another five days were added. The most recent extension was by 20 days.
Criminal Court's order on May 15 to remand him for 20 days expires on June 3. Raudh was released on May 22 while this order was still in effect. He was released because Prosecutor General's Office advised that Police had acted against procedure in the initial arrest.
Just hours after his release, Raudh was rearrested under a new court order. This time, the Court placed him in custody for five days, which is set to expire today.
Raudh's lawyers raised concerns about there being two active remand orders against Raudh. They maintain that the 20 day remand order remained in effect as no court had revoked it. Hence, they said that there are two active remand orders against Raudh regarding the same charges.
Lawyers raised these concerns at the remand hearing as well. As per the court order, Police had responded that Raudh had been released as it was believed there were procedural issues in the remand order.
Criminal Court Judge responded to this by stating that it is not within the Police's purview to decide whether there are procedural issues in a court order, stating that such a decision can only be made by the High Court or Supreme Court.
Raudh's defence lawyers also submitted a case to High Court claiming procedural issues in his remand, but the case was later withdrawn upon his release.
