The state on Wednesday sought to annul a clause in the Political Parties Act that allows an expelled parliamentarian to preserve his seat even though the member will no longer be representing the party.
The state announced their decision during the anti-defection hearing of Villingili MP Saud Hussain.
The state stated that they were specifically looking to annul Section 16 (2) of the Political Parties Act.
However, the apex court on Wednesday did not comply with the state's request and maintained that no changes will be brought to the specific section of the Act.
Earlier in July, the Supreme Court issued a ruling which stated that any parliamentarian that resigns or is expelled from the political party they were registered to at the time of election, or shift to another party, will lose their seat in the parliament.
The apex court had clarified its ruling just two days later on July 16 and held that the ruling could not be applied retroactively.
