Maldives High Court has decided that it will not review cases of indefinite detention pending trial of persons in relation to appeal cases being conducted by the court.

As per the Criminal Procedures Code, remand of persons held in detention until the end of trial must be reviewed monthly. However, it does not specifically stipulate that the detention of those involved in cases being appealed at the High Court need to be reviewed in this manner.

Last year, High Court ordered the remand until completion of trial of one accused in the murder of Nadheem Ibrahim. Nadheem was murdered by a group of assailants while in a cafe' in Male' City in July 2017.

The State asked the Court to review the defendant's remand in accordance with the Criminal Procedures Code.

The High Court ruling on this issued on Tuesday notes that the law does not stipulate the review of the detention of those held in remand while an appeal case is ongoing.

The three judge bench voted unanimously that cases cannot be submitted to the High Court seeking review of the detention of persons in the midst of an ongoing appeal case.

The bench included Judge Hussain Mazeed, Chief Judge of High Court Hussain Shaheed and Judge Mohamed Saleem, with Judge Mazeed chairing.
