Emergency motion against SC bench decrease rejected

Parliament has today rejected the emergency motion submitted by opposition Maldivian Democratic Party (MDP) stating that decreasing the number of judges on the Supreme Court bench while the court is hearing a constitutional case on MP dismissals is an undue influence over the court.

The case in Supreme Court was submitted by former MP and lawyer Ali Hussain, seeking to revoke an amendment brought to the Constitution last year on members losing their parliamentary seats.

A bill was submitted yesterday to Parliament proposing that the number of Supreme Court Judges be decreased from seven to five. The bill was proposed as a private submission by ruling People's National Congress (PNC) MP for Holhudhoo AbduSattar Mohamed.

An emergency motion alleging that this is an attempt to influence the Supreme Court was submitted by MDP MP for South Galolhu Meekail Ahmed Naseem.

Speaker of Parliament Abdul Raheem Abdulla rejected the motion, stating it involved a matter that will be debated in parliament in relation to the submission of a bill.

The emergency motion stated that decreasing the number of Supreme Court judges, at a time when they are hearing a sensitive case concerning the Constitution, was proposed with the intention of influencing the court.

It said that if the bill is passed, it will adversely affect the separation of powers stipulated in the Constitution, granting the government power over all branches of the State.
