High Court ruled on Tuesday that the detention of the driver of a sports car involved in an accident in Hulhumale' where one person died is justified.

The accident occurred near Central Park in Hulhumale' when a sports car and a motorcycle collided, resulting in the death of the motorist.

Mohamed Visam Sidhqi of Violet Fehi, Seenu atoll Hithadhoo, the driver of the sports car, was arrested following the accident, with the Hulhumale' Magistrate Court ruling that he be held in remand in custody until the end of trial.

The ruling was appealed at the High Court by Visam. High Court, in it's ruling yesterday, said that the Hulhumale' Magistrate Court had ruled to keep Visam in custody based on the evidence available at the time.

The court said that Visam's current claims about how the motorist had been driving are not proven as of yet and were not submitted to the lower court, and hence the High Court cannot rule on the lower court's verdict.

Visam also raised the issue of Criminal Court now being located in Hulhumale', stating that while this is so, the Hulhumale' Magistrate Court can no longer rule on remand cases. The High Court dismissed these claims, stating there is no legal basis for this. They stated that the Supreme Court had earlier ruled on the validity of the Hulhumale' Magistrate Court, and the running of the Criminal Court in any Male' area location does not affect the jurisdiction of the Hulhumale' Court.

With the majority of the Judge's vote, with Judge Fathimath Faruheeza and Judge Abdul Maniu Hussain supporting, the High Court ruled that there is no reason to change the lower court's decision to hold Visam in custody.

Judge Hassan Shafeeu differed, saying that Hulhumale' Magistrate Court's order should be revoked.
