The incident involved the demolition of a wall at Henveiru Hudhufinifenmaa by the city council after it was erected with the council's permission to construct a wall in the alley separating two houses. The wall prevented residents of the adjacent house from accessing their home. Although the council initially allowed the construction, it later decided to demolish the wall.
Hassan Shakir, the owner of Hudhufinifenmaa, sued the city council, challenging its decision to demolish the wall after previously granting permission to build it. Shakir also sought an order to maintain the property as it was until the case was resolved, which the court granted.
Civil Court held that the city council was liable for the damages caused to Shakir due to the wall’s demolition. Should Shakir file a separate case seeking compensation, the court will consider it.
Despite being given an opportunity to respond, the city council failed to file a defense within the allotted time, citing a system error. The court proceeded with the case in the council's absence, rejecting its request for additional time to file a defense after the deadline had passed.
