Case of three Supreme Court judges submitted to JSC

Case of three Supreme Court judges over their order issued on February 1, 2018, was submitted to the Judicial Service Commission (JSC) on Sunday.

While the order was issued in an unanimous decision by the five judges bench at the time, the three judges who remained after the arrests of then-Chief Justice Abdulla Saeed and Judge Ali Hameed amidst a state of emergency declared by the then-administration, signed of on an order that voided certain aspects of previous order.

According to local media Mihaaru, the case submitted to the JSC was against incumbent Chief Justice Dr Ahmed Abdulla Didi, Judge Abdulla Areef and Judge Adam Ahmed Abdulla over the Supreme Court order they signed to issue afterwards.

JSC has yet to issue a statement regarding the issue..

While the case was submitted to the JSC against the three judges, the commission is still investigating the case against Supreme Court Judge Abdulla Didi. Although JSC decided to suspend Judge Didi, the Supreme Court delayed implementing the suspension.

Stating that the order issued on February 1, 2018, was an unconstitutional, the previous administration did not implement the order. Under the terms of what is considered to be the strongest ruling that the Supreme Court has yet issued, the release of political detainees and the reinstatement of the 12 ousted lawmakers were ordered by the top court.
