The Parliament on Wednesday, passed a motion charging the Judicial Service Commission (JSC) with ensuring Supreme Court judges meet the requirements of their posts.
The motion submitted by Henveiru Central MP and Maldivian Democratic Party (MDP) member Ali Azim, also assigned JSC to ascertain whether any corruption cases were lodged against the judges.
Furthermore, the motion proposed that JSC investigate and decide an outcome on the two Supreme Court orders that 'unconstitutionally' impinged on the authority of the parliament and subsequently follow up with a report.
Furthermore, Thulhaadhoo MP and MDP member Hisaan Hussain articulated that if the Supreme Court were to step outside its jurisdiction and encroach on the powers vested in the Parliament, the legislative body may require using its authority to take measures against the court.
She then submitted a resolution with three proposals which was approved in the parliament.
The Supreme Court issued a stay order regarding JSC's suspension of the apex court Judge Abdulla Didi over the investigation into the Justice's bribery charges. Further, the top court issued an order nullifying any and all actions taken by the parliament or other state institutions which disregarded the stay order.
The Supreme Court, additionally on Tuesday, issued an order that the parliament should not have authority to decide on an outcome for JSC's investigation into the case against Judge Didi.
Hisaan's resolution states that the two orders issued by the Supreme Court were unconstitutional and encroaches on the authority of the parliament, and further identifies the importance of calling on the top court to stay within the boundaries of the constitution.
