Judicial Service Commission (JSC) on Wednesday decided to submit a motion to the parliament to dismiss a judge.
At a press conference, the commission's Director Hassan Zaheen revealed the judge to be Thinadhoo Magistrate Court's magistrate Ibrahim Rasheed.
According to Zaheen, the commission reached a unanimous decision to file Ibrahim Rasheed's case in parliament following an investigation that was carried out by JSC.
"We don't have the power to dismiss any judges", Zaheen said.
According to the Constitution, judges can only be removed by a two-third majority vote of all the members present in a parliament session, based on a submission by JSC, who is tasked with the responsibility of investigating and taking measures against problematic judges.
However, till date, no judge has been dismissed this way.
Formerly, JSC requested the removal of Chief Justice Ahmed Faiz Hussain and Judge Ahmed Mu'uthasim Adnan but they were dismissed under an amendment brought to the Judicature Act in 2014, reducing the number of judges presiding on the Supreme Court bench.
The next Chief Justice Abdulla Saeed and Supreme Court's Judge Ali Hameed both left their posts following the conclusion of their appeal processes when they were both found guilty of criminal offences.
