Unlawful sacking subjects to MVR 1.4M compensation

Sun Investment has been ordered by Maldives Employment Tribunal to pay MVR 1.4 million in damages to one of its employees for unlawful termination.

The case is concerned with the Sun Aqua Iru Fushi Resort's Resident Manager, who was employed at the designation for a two-year period since 2019. The tribunal claimed the individual's employment at the resort for the period of concern has been verified, adding their termination was in breach of existing laws.

The employee was terminated from the property in February 2021.

The tribunal's judgment demanded Sun Investment to pay MVR 993,000 in remuneration and allowances, that were deducted from the employee. Additionally, the company was ordered to pay MVR 462,000 which is the employee's remuneration and allowances for a period of six months, paid as damages for the unlawful termination.

Furthermore, the tribunal identified the employee was terminated without a valid, lawful reason and in absence of legally enforced notice procedure. The tribunal has ordered Sun Investment to settle the compensation within a three-month duration.
