The High Court (HC) on Wednesday, sentenced a man to 10 years in prison over his involvement in the murder of Noor Adam Hassanfulhu, near Indira Gandhi Memorial Hospital (IGMH) on late March, 2015.
Although two minors at the time were charged at the Juvenile Court, only one assailant was found guilty of murder and was sentenced to death as the other individual was initially found 'not guilty'. The state later appealed the matter at the High Court.
Noor's assailant and the individual fled the scene on two separate motorcycles together after waiting for Noor near the hospital.
During the verdict hearing, HC ruled that even though the individual was not directly involved in assaulting Noor, witness testimonials prove that the youth was an accomplice to the murder, sentencing him under the Intimidation and Possession of Dangerous Weapons and Sharp Instruments Act (17/2010).
Out of the bench of three High Court Judges, Judge Abdul Rauf Ibrahim and Judge Abdulla Hameed decided in favour of conviction. Judge Ali Sameer opposed the verdict, adding that witness testimonials indicate that the individual did not partake in the murder other than fleeing the scene with the assailant.
The crime of being an accomplice to murder carries a prison sentence of 15 to 25 years. However, he was awarded a more lenient sentence as a juvenile offender.
HC's verdict noted that the individual was ordered to seek rehabilitation, and if successfully competed, he stands a chance for a reduced sentence.
There are two additional ongoing cases against over Noor's murder.
