Unlikely to recover ventilator compensation, but will exert every effort: AG Usham

Efforts are ongoing to lodge a case at Dubai's courts to claim the MVR 32 million due in compensation for Dubai’s Executors General Trading’s failure to provide ventilators, although the AG believes recovery of the funds to be highly unlikely.

Efforts are ongoing to lodge a case at Dubai's courts to claim the MVR 32 million due in compensation for Dubai’s Executors General Trading’s failure to provide ventilators for the treatment of critical Covid-19 patients according to the agreement with the former government.

The case regarding failing to comply with the agreement entered into on February 2, 2020 was submitted to Maldives International Arbitration Center last February. Maldives had sought compensation for the damages incurred as a result of Executor’s failure to provide the agreed ventilators, alongside reimbursement of funds for the unsupplied ventilators, which sums up to a total of USD 2 million (MVR 32 million).

A statement released by the Attorney’s General office on February 27 stated that the Arbitration's final verdict on the case mandated the Executors General Trading company to compensate the price of the ventilators, USD 1,888,750 to the Maldivian administration, alongside paying an annual interest of two percent to the Maldivian government from May 2, 2021 until the payments are completed.

Executors General Trading had not attended any hearings of the case.

At yesterday's press conference, Mihaaru News enquired about proposed methods of recovering these funds.

Attorney General Ahmed Usham responded that even as the arbitration had proceeded, the whereabouts of the company had remained unknown, nor had they submitted any statements.

However, as the company has been registered in Dubai, Usham said that efforts are ongoing to submit the case to the courts of Dubai and proceed through them.

"In consideration of how things have gone so far in this case, recovering these funds is highly unlikely. However, we will do all we can in our efforts to do so," Usham said.
