High Court orders to halt Civil Court case regarding Yameen seeking access to his USD 1 million

High Court has ordered a halt on the Civil Court case submitted by former President Abdulla Yameen seeking access to his funds of USD 1 million (MVR 15 million) held in an escrow account made between himself and the ACC.

High Court has ordered a halt on the Civil Court case submitted by former President Abdulla Yameen seeking access to his funds of USD 1 million (MVR 15 million) held in an escrow account made between himself and the Anti Corruption Commission (ACC).

The funds were transferred to an escrow account opened at the Bank of Maldives (BML) by the ACC and Yameen in 2018 until the commission completed its investigation into corruption allegations at the Maldives Marketing and Public Relations Corporation (MMPRC). As the funds have not been released to date, Yameen submitted a case against ACC and BML at the Civil Court.

The Civil Court dismissed a procedural point raised by BML where they claimed that Yameen cannot file a case against the bank. BML then appealed this ruling at the High Court and requested a halt order against the Civil Court case until their appeal case is completed.

The High Court's order in the matter on Sunday stated that if the Civil Court completed the case before the High Court completed the appeal hearing, then it would make the High Court's ruling inconsequential. Additionally, they said, not issuing a halt order may prove detrimental to the bank. Therefore, the High Court issued an order to halt the Civil Court's case until the High Court rules on the appeal case.

The case is being presided over in High Court by Chief Judge Hussain Shaheed, Judge Dheebanaaz Fahmy and Judge Fathimath Faruhiza.
