Due to the unintentional destruction of a motorcycle towed by the police, the Civil Court orders the Maldives Police Service (MPS) to pay MVR 82,000 in compensation to the owner.
The owner of the vehicle sued the police for loss incurred after being told the motorcycle had been lost while kept in the Hulhumale' tow yard.
This motorcycle was towed by the police after being involved in a road accident in Hulhumale' in April 2022.
The State has said during the hearing that the motorcycle was not lost, but rather accidentally destroyed.
The court ruling states that the cost of the motorcycle, MVR 57,000 and the cost of contracting an advocate for the lawsuit, MVR 25,000, which amounts to a sum total of MVR 82,000, must be compensated to the owner.
The mandate stipulates the settlement of the compensation within 7 days from 15 January.
During the lawsuit, an appeal for MVR 19,000 in punitive damages was submitted however, the ruling stated that these funds cannot be issued.
The court said in their ruling that this is due to the accidental nature of the issue in question and clarifies that punitive damage reimbursement is dispensed due to intentional destruction of property.
The decree also states that the owner must abolish his rights to appeal for funds in compensation of any extra costs that may have previously been expended on the destroyed motorcycle.
Previously, due to the unlawful destruction of a car towed by the police, the Civil Court had ruled for compensation in the monetary equivalent of the car, MVR 250,000.
The compensation was paid as a result of the police destroying the vehicle before disclosing to the owner that it was towed.
