The Supreme Court has overturned the high court's ruling to terminate an agreement to develop a water theme park in Hulhumale' and take back the property.
HDC (present-day Urbanco) cancelled its 2017 agreement with Water Front and Lesha company to develop a water theme park and hotel last year, following which Water Front Company filed a case in court.
The court sought an interim injunction restraining the civic body from taking possession of the premises until the case was closed. The decision was challenged in the High Court, which passed an order restraining HDC from taking possession until the disposal of the case.
The decision was subsequently challenged by HDC in the Supreme Court, which ruled that in the event of an appeal against an interim order, it is possible that an interim order may have been passed in the appeal. Therefore, in such cases, it would be fair to decide the appeal expeditiously, the three-judge bench said.
In this case, Water Front Company had approached the High Court and the court's interim order had sought only one treatment, the court said. Therefore, it is possible that a decision had already been taken on the appeal earlier.
Justices Mahaz Ali Zahir, Dr. Mohamed Ibrahim, and Ali Rasheed ruled to overturn the high court's order.
