Drug peddler suspect released over health concerns

A taxi driver, who was arrested on suspicion of possessing one kilogram of drugs, has been released due to health conditions and in consideration of their service to the public.

Mohamed Migdhad, aged 45, was arrested during an anti-drug operation by local law enforcement authorities in August 2023. Authorities inspected Migdhad's residence, where they discovered over one kilogram of drugs, packing materials for packaging, and a sum of money.

He was charged with one count of trafficking cannabis and one count of trafficking diamorphine. Both charges, identified as serious indictable offenses, carry a life sentence.

Although the taxi driver was arrested and initially remanded until the conclusion of the trial, Judge Hussain Faiz Rasheed decided to release him on Wednesday, December 27. This decision was primarily influenced by the impromptu revelation of a surgery he must undergo during a trial hearing.

The court, in its verdict, noted that the defendant had lodged multiple complaints regarding health issues during his remand. However, the state did not inform the court of the health complaints made by Migdhad while in remand under the supervision of the Maldives Correctional Service.

The defendant revealed that he had benign lumps on the heel of his left foot, for which doctors have recommended immediate varicose vein removal surgery. He also disclosed that delays to the surgery could severely impact him, leading to the possibility of permanent disability.

The Judge in the court's verdict further held that the DNA report and other evidence submitted by the prosecution in the case were not sufficient to link causality between the driver and the discovered narcotic substances.

The verdict also noted that the driver does not have a criminal record and has earned a living through taxiing.

The defendant during Wednesday's trial requested for a conditional bail.

The Judge observed the defendant's health conditions and his service as a taxi driver, and was released provided that he agreed to the conditions set by the court.
