Motion of no confidence filed against Prosecutor General Aishath Bisham, a second time

Another motion of no confidence was filed against Prosecutor General (PG) Aishath Bisham on Wednesday, the second attempt to do so this month.

The motion was submitted to the Parliament by Jumhooree Party member and parliamentary representative for the Thinadhoo South constituency, Abdulla Ahmed.

The initial motion of no confidence against Prosecutor General Aishath Bisham filed by the same MP Abdulla on November 20, was withdrawn on the same day.

According to MP Abdulla’s recent tweet, the new motion adds to the claim that many lawmakers had been prosecuted and imprisoned unlawfully, which the earlier filing pivoted on.

As such, the newly filed motion states that PG failed to carry out the tasks and responsibilities while many were incarcerated anticipating a verdict, adding that the political prisoners were not afforded basic necessities and that complaints concerning prison conditions had not been investigated.

Further, the motion also states an incident involving the alleged kidnapping of a parliamentarian’s wife whilst he was in police custody, claiming PG had not made any comment nor taken any steps to ease the situation. The parliamentarian is assumed to be MP Ilham Mohamed of Dhangethi, who had accused police of detaining his wife, whilst he was himself summoned to the police station in February.

The former Attorney General, Bisham was appointed to the role of Prosecutor General in 2015, after former PG Muhthaz Muhsin unlawfully, following a vote of no confidence. Bisham was then legal advisor to former President Abdulla Yameen Abdul Gayoom at the President Office.

Prior to Muhthaz, then PG Ahmed Muizzu had resigned due to the parliament's intention to cast a vote of no confidence against him

The current ruling coalition previously accused Bisham of filing charges against political leaders under politically motivated orders from the former President Yameen.

As per Maldivian law, though the power to appoint and remove the PG from office lies within the parliament, the Supreme Court has the final say regarding the matter.
