Top court regains power as President Yameen lifts SOE restriction

President Abdulla Yameen on Tuesday evening lifted the restriction which had curtailed the authority of the Supreme Court during the ongoing state of emergency in the Maldives.

According to the President’s Office, Yameen amended his presidential decree concerning the SOE to lift the suspension of Article 145 (c) of the Constitution, which states that “The Supreme Court shall be the final authority on the interpretation of the Constitution, the law, or any other matter dealt with by a court of law.”

This is the second amendment to his decree since the president declared the state of emergency Monday night, after a deadlock on the Supreme Court ruling which ordered the release of political prisoners and reinstated legislators that were suspended for defecting from the ruling party.

The first amendment came earlier Tuesday when Yameen had suspended Article 48 thus curbing the rights of arrested or detained persons.
