Lower court throws out lawsuit on main opposition re-elections

The Civil Court dismissed the lawsuit filed by former deputy of main opposition Maldivian Democratic Party (MDP) Alhan Fahumy against that party to elect a new leader and deputy leader.

The Civil Court’s decision says that the Elections Commission’s letter and the words of the plaintiff and defendant prove that Alhan Fahumy is not a member of MDP since November 28.

Hence, Alhan no longer has the authority to file a lawsuit against MDP, said Judge Mohamed Haleem.

Alhan Fahmy, who was exiled from MDP for acting in violation of the party’s interests, filed the lawsuit citing that the term of the current leader, Former President Mohamed Nasheed and deputy leader Mohamed Shifaz, was up.

During the trial, MDP claimed that Alhan is not a member of the party and, hence, does not have the rights of membership or the authority to question the dates of party’s internal elections.

Alhan asserted that Dr Ibrahim Didi was elected as the leader of MDP on May 2011 while Alhan himself was elected as the deputy leader. However, they were removed from power on April 30, 2012 despite their tenure being incomplete.

Alhan was expelled from MDP after 50 members signed a petition stating that his actions hinder the vision of the party. Therefore, the Disciplinary Committee of MDP gave a chance for Alhan to apologize for his actions and to put forward 50 membership forms to join back the party.

However, Alhan did not follow the order.
