Supreme Court To Review Challenge on Establishing Paternity through Civil Means

The State has elevated to the Supreme Court the High Court's ruling that paternity of a child in state custody cannot be established on civil grounds for citizenship approval.

The case revolves around determining the father of a child born to a Maldivian man and an Indonesian woman shortly after their marriage abroad. Following the woman's departure, the child was placed in state custody. Seeking to grant citizenship in line with the Constitution, which confers citizenship to children born to local parents, the state approached the family court to prove paternity of the local man through civil standards.

Both the family court and the high court ruled against proving paternity on civil grounds.

Yesterday, the state escalated the matter to the Supreme Court, contesting the decision.

However, the Supreme Court has not yet made a decision on whether to accept the plea.

The High Court determined that paternity cannot be established through civil means beyond the judicial process. It emphasized the potential for granting Indonesian citizenship to the child due to the mother's Indonesian nationality.
