Death Penalty against two: case halted at High Court for 4 years

High Court has granted the third extension to find legal representation in the appeal case submitted by the two who were convicted of the murder of Muheeth and sentenced to death by the Criminal Court.

High Court has once again granted an extension to the two convicted of Abdul Muheeth (Bobby)'s murder 11 years ago.

The two accused, Mohamed Maimoon of Zaithoonige in Lhaviyani Atoll Naifaru and Muhujath Ahmed Nasih of Ablaeege in Gaafu Dhaalu Atoll Gahdhoo, were convicted of the murder and sentenced to death by the Criminal Court in 2019.

Their appeal case has been lodged at High Court for four years, being prevented from proceeding due to their lack of legal representation. The High Court has once again granted an extension allowing them to seek lawyers.

Asked about the lack of legal representation in court today, both claimed that they had previously had lawyers.

The court, however, said that they had not received any documentation proving the appointment of a lawyer, noting that extensions to find lawyers had already been granted on two previous occasions. The bench of judges enquired whether they had faced difficulties in appointing a judge as they are currently in detention.

Maimoon said that he had been notified by Corrections Services of today's hearing only late last night. He added that he is expected to hire a lawyer through a phone call.

The bench ruled that an additional opportunity will be granted to seek legal representation, ordering that a lawyer be appointed by the next hearing.

The High Court bench, presided by Judge Abdul Maniu Hussain, also includes Chief Judge of High Court Hussain Shahid and Judge Fathimath Faruhiza.

Muheeth was murdered by a group of assailants in a cul-de-sac in front of the Finance Ministry in 2019.

Two others were convicted of Muheeth's murder by the Juvenile Court, also resulting in death sentence. High Court has previously upheld this ruling, and the case is now appealed at the Supreme Court.
