Parliament on Wednesday, passed the motion to dismiss Supreme Court Judge Abdul Ghanee Mohamed from his position on the apex court bench.
As per the constitution, a judge can only be dismissed through a parliamentary vote based on a motion put forward by the Judicial Service Commission (JSC). The motion must be passed with a majority vote by one-third of the members present in the session.
A total of 64 members voted to dismiss the Chief Justice and Judge Adam during Monday's session. Two MPs voted against the motion.
Prior to the vote, Parliament's Judiciary Committee reviewed and accepted the Judicial Service Commission (JSC)'s decision to remove Judge Ghanee from the Supreme Court.
According to JSC, certain actions committed by Judge Ghanee were in violation of the Judicature Act and was grounds for his dismissal.
In what is a string of reforms within the judiciary, the parliament on November 18, sacked former Chief Justice Dr Ahmed Abdulla Didi and Judge Adam Mohamed Abdulla of the Supreme Court from their positions.
Currently, the Supreme Court's bench consists of Judge Dr Azmiralda Zahir, Judge Aisha Shujoon Mohamed and Judge Mahaz Ali.
