The High Court on Wednesday nullifies the sentence by the lower court against former Supreme Court Judge Ali Hameed.
Ali Hameed was sentenced to one year and six months of jail time for refusing to hand over his phone to the police after his arrest following the declaration of state of emergency by former President Abdulla Yameen Abdul Gayoom in February.
The declaration came after the infamous Supreme Court ruling to reinstate then unseated parliamentarians and to release political prisoners.
The state charged him for obstructing enforcement of justice.
Ali Hameed’s defendant lawyer Noor al-Salaam told Mihaaru that the High Court has annulled the charges against former Supreme Court judge due to lack of witnesses and procedural issues.
He had appealed the case to the High Court and during the court hearing, stated that he was arrested after the Supreme Court’s full bench made a unanimous decision.
According to him, he was at the Supreme Court when a group of people with their faces covered forcibly entered the Supreme Court after breaking the door and demanded that he hand over his mobile phone.
He stated that such actions could not be allowed to happen in the highest court of the judiciary sector.
