Civil Court dismisses Hassan Waheed's case against Valencia

The court dismissed the case on grounds of unfulfilled requirements.

In case raised by former board member of Valencia Sports Club Hassan Waheed against the club's board, the Civil Court on Tuesday ruled that the court would not be able to issue a verdict on the matter.

The former head of maintenance at Football Association of Maldives (FAM) was removed from Valencia's board on 11 December 2023. Waheed and four others filed a lawsuit claiming Valencia's board violated the club's governing regulations by doing so, and sought to overturn the decision.

The lawsuit was submitted by Hassan Waheed, who maintains close ties with former FAM president Bassam Adeel Jaleel, Valencia's Vice President and assistant coach Ilmaau Hussain Ibrahim, former Valencia player and current board member Yoosuf Rameez, as well as two relatives of Bassaam, Misbaah Mohamed and Ali Mamdhooh Mohamed.

Valencia's current chairman Abdullah Azmeen was elected to the post on 11 December 2023 as well. In the lawsuit, the plaintiffs also sought to declare the former sports journalist and football commentator's appointment as an infraction.

The lawsuit said that Azmeen's no-confidence motion was passed by the club's board on 26 December, 2023 but that he had resigned on the same day as well.

However, two days later, on 29 December, 2023, a board meeting was held with prepared documents levelling "baseless" allegations against Hassan Waheed, Misbah and Mamdhooh, the lawsuit said.

The lawsuit also sought to recover the costs of hiring a lawyer.

The Sports Commissioner's Office recognised Azmeen as the legitimate chairman of the club.

After reviewing the case, the Civil Court ruled that there was no legal basis for suing Valencia to overturn the decision of the Sports Commissioner, given that the Sports Commissioner's decision still stands.

The court noted that the Sports Act clearly explains that if a club is suspected of violating their governing regulations, the matter first must be decided on by the Sports Commissioner's Office.

The court also noted that the Sports Act clearly states that if a party is not satisfied with the Commissioner's decision, the case would have to be appeal with the National Assembly for Sport (Sports Council). However, the Civil Court noted that the case was filed to the court without fulfilling these requirements.

- Board Member: Ahmed Sharif (Maadey) As such, Judge Abdul Nasir Shafeeq said that Hassan Waheed and other plaintiffs had not filed the suit in accordance with the Civil Procedure Act, and that due to this, the court would not be able to issue a verdict on the matter.

The ruling also said that Valencia was not required to pay the costs of legal counsel incurred by the plaintiffs as they had lost the case.
