Civil Court ordered on Sunday for Maldivian man to repay MVR 82,000 he had received from former lover.

This case involves a USD 4,300 (MVR 66,000) and MVR 37,000 a Maldivian man had received from a Maldivian woman while they were in a relationship. While the woman had recovered MVR 21,000 of that money with the aid of the police, she lodged her case in the Civil Court in order to obtain the remainder of the money.

The man agreed in court that he had received money from the woman while they were in a relationship, but had insisted he did not received it on the condition that he had to pay it back. He had additionally said she started asking for the money once they had split up.

The court ruled that even though the both of them were in a relationship when he received money, the woman was not in a position where she had to pay for the expenses of the man. As the man had failed to prove that the money he received was a gift, the court stated he had to repay her.

According to the ruling, repayments will not be necessary in such cases if the money was spent by a person who was in the position of where they have to be financial responsible towards the other party, or if the money was given as a gift. However, proving the money received was a gift falls on the shoulders of the person that received the money.

In the ruling made in absentia of the man, the court ruled that he had to repay USD 4,300 and MVR 16,000 to the court within a one month period.

Such cases have lead to similar rulings by the Civil court in the past as well, where they ruled he man will have to repay money they received from the woman while they were in a relationship, even in legal marriages. When appealed, the High Court later sustained the ruling as well.
