Supreme court accepts case seeking revocation of amendments easing impeachment

The case submitted by the AG seeking annulment of the recent amendment to parliament's guidelines that allows MDP - who holds majority of the parliament seats - to impeach the president on the votes of the opposition alone, has been accepted.

Supreme Court has accepted the proposition by the State to annul the amendment to the Parliament Regulations that allows opposition party MDP (Maldives Democrats Party) to approve the President and Vice President’s impeachment through votes of opposition leaning MPs alone.

The Constitution dictates that the President and Vice President may only be dismissed following the approval votes of two thirds of the Parliament. The Parliament guidelines amended last year allows the total number of members to be counted excluding the seats currently vacant for various reasons.

The annulment of this amendment that was proposed to the Supreme court last month by the Attorney General, Ahmed Usham, was accepted by the court yesterday.

However, the first hearing of the case is yet to be scheduled.

The guideline was amended due to the presence of 6 empty seats in the parliament as a result of a few parliamentarians relinquishing their seats to assume positions at State offices.

Therefore, under this amendment, MDP has the opportunity to impeach and dismiss the president with votes from their party and those of the The Democrats.
